Terms & Conditions (T&Cs)

 

The Terms and Conditions (T&Cs) apply to the whole of www.rosyrosie.com. Please read them carefully as by using the website, including placing an order and/or completing any customer registration with us you are deemed to have understood and agreed to accept these T&Cs.

These T&Cs are subject to change and it is your responsibility to check them regularly in case of any changes. If you have any queries about the T&Cs then please contact us before placing an order. If you do not agree with any of the T&Cs then please do not use or access the website.

 

Use of the website (www.rosyrosie.com) and registration

You must be 18 years or older to use the site. If you are under 18 and don’t have the agreement or supervision of a parent or guardian then please do not use the site.

You warrant that all the details you provide to www.rosyrosie.com when registering as a customer and for ordering purposes are true, accurate, complete and current in all respects. And it is your responsibility to inform us of any changes – including your email address. You also warrant that the credit or debit card that you use is both your own and that there are sufficient funds to cover payment of any goods or services ordered.

You agree that email can be used as a method of communication.  During registration you will be asked to choose a username and password. You are then responsible for all use of the website and actions taken under that username and password. You must make every effort to make sure that you keep your username and password safe and do not disclose it to anyone.

You are responsible for preventing any unauthorised use of your user name and password and if you think others might know them then you should change them. If you believe that there has been any breach of security such as disclosure, theft or unauthorised use of your user name and password then tell us immediately.  

If following registration with www.rosyrosie.com you decide that you no longer wish to remain registered then you may cancel by sending us a notice of cancellation.

It is a crime to use a false name or a known invalid credit/debit card to order.

Rosy Rosie reserves the right to terminate our agreement with you immediately and without notice if you fail to make payment to us when due; you breach any of our T&Cs; you fail, when requested by us, to provide enough information for us to check the accuracy and validity of any information supplied by you or your identity; we suspect that you have engaged, or intend to engage in actions that are fraudulent, illegal or might cause legal liability for us or our (registered or otherwise) users.

You agree that if you break these T&Cs or any liabilities are incurred arising out of your use of www.rosyrosie.com, you will be responsible for the costs that we or our offices, agents and suppliers incur as a result of the breach; including reasonable legal fees (if applicable). You will remain liable if someone else uses your shopping account and/or personal information unless you can prove that such use was fraudulent.

 

Privacy - including cookies

When you place an order with us we collect information such as your name, email address, mailing address, contact telephone numbers, credit card or other payment information and password. We may also record which products have interested you and which you have purchased. We also monitor site usage and browsing habits.

All of this data collection is so we are able to process orders, provide good customer service and keep the site up-to-date with customer needs. We might use this information to tell you about new products and services for example if you have agreed to subscribe to our newsletter. You might receive the occasional email mailing regarding new products or offers. You can always unsubscribe from the newsletter or opt out of mailings at any time.

Cookies are small text files that are sent to your browser and stored on your computers hard drive. They are useful because they allow a website to recognise a users device. They do lots of different jobs like letting you navigate between pages efficiently, remembering your preferences and generally improving the user experience. We use them to allow us to store your account information and provide features to make your shopping on the website easier. They do not store any sensitive information such as credit card information. We also use cookies for analytical purposes, where our aim is to help us understand how visitors are using the site and therefore help us improve the site and the user experience. Again, no personal or sensitive information is collected. The majority of cookies, including ours, are nothing to worry about and if you wish, you can modify your browser to prevent storage happening. However, we would observe that by disabling cookies you can impair website usage in that you can use the site to research and browse but not to purchase.

We use your IP address to help keep or site running smoothly and to help identify your shopping cart.

All of your personal details are entered onto our website via a secure SSL connection. We will never share any information you give us with any third party. 

 

Security

We have done our very best to ensure the security and privacy of our system and the storage of users data and personal information. Our website uses PayPal Payment Pro to process credit card payments. At the checkout you are linked to PayPal Payment Pro via an SSL (Secure Sockets Layer) encrypted secure page.  

SSL encrypted pages provide the best possible protection on the internet. When you enter your credit card details they are input into PayPal Payment Pro’s secure site and we do not have access to them. You can check you are on a secure site when the padlock appears in the address bar at the top of the screen.

 

Ordering

When placing an order, you agree that any and all information given is accurate and complete.

All orders are subject to acceptance and product availability. Product availability is listed on individual product descriptions. Some of our handmade products are made in very small quantities and will be subject to rapid change. If there is any issue over stock (there being only one left and someone else orders at the same time as you) we will refund your account. Occasionally, we will need to ‘make to order’ (for example candles) which will incur a potential time delay and you will be advised by email.

No contract for the sale of any product(s) will exist between you and www.rosyrosie.com until we accept your order by dispatching the product(s) to you. When this happens will send you a confirmatory email. This confirmation of acceptance will be sent to the email entered in the order form and it will detail the product(s) ordered, payment method and costs.

You must check that the details on this confirmatory email are all correct and contact us as soon as possible if they are not.

For a short while you might be able to cancel a placed order. However, once you have received an email confirming despatch of your order then you will have to return the unwanted items at your expense.

If your order has not been accepted then you will receive an email from us explaining the reasons why.

 

Pricing

All prices listed on the website are correct at the time of entering the information. However, we do reserve the right to change the prices of any product at any time. All prices are shown inclusive of any sales tax.

 

Payment

The payment of an order must be received by us and cleared before we dispatch your items. We accept most cards for online payments and all transactions are in pounds sterling. We are not liable for any unauthorised transactions or any denied payments that occur as a result of information you have provided.

 

Delivery

The delivery period within which you receive your ordered goods is approximate. We would aim to dispatch as soon as we have received cleared payment to the address you provided in your order. If an item is out of stock then we will let you know as soon as possible, giving you an expected despatch date.  

If your delivery address is outside the UK you may have to pay import duties and taxes which are levied once a shipment reaches your country. You must meet any additional charges for customs clearance. Please note that customs policies vary widely from country to country. We recommend that you contact your local customs office for further information. Also please note that international shipments may be subject to cross-border inspections by customs authorities.
